These terms cover DocketDeck at www.docketdeck.com and every page on it. Using the site means you accept them. If you do not accept them, please stop using the site.

The short version: we publish a directory, we are paid by the vendors we list, and we are not responsible for what happens between you and any vendor you find here. The detail is below.

Who we are

DocketDeck is an independent directory. We are not a reseller or an agent for any product listed here, and we do not take a commission on anything you buy from a vendor. When you contact a vendor you found on this site, your relationship is with that vendor, not with us.

What this directory is

Every listing is submitted by a vendor who pays a one-time fee for the editorial review that follows. An editor reads each submission and takes down anything that misrepresents itself.

The Featured slot is sold by open bidding and is always labeled as paid placement. Beyond that slot, nothing here is a position that money can buy, and paying us never changes the review standard.

We are not responsible for the vendors we list

A listing is not an endorsement or a certification. Our review is editorial, not an audit. We do not test security, verify uptime claims, read contracts, or confirm that a vendor can do what it says it can do.

You are responsible for evaluating a vendor before you buy. We are not a party to any agreement you enter with a vendor, we earn nothing from that agreement, and we have no ability to intervene in it.

We are not liable for anything that follows from your dealings with a listed vendor. That includes lost or corrupted data, downtime, security incidents, billing disputes, contract disputes, regulatory problems, and lost business. If a vendor fails you, your remedy is against that vendor.

Outbound links leave this site through a redirect on our domain that counts the click. The destination is a third-party site we do not control and are not responsible for, including its content and its own terms and privacy practices.

Fees and refunds

Fees paid to DocketDeck are not refunded. There is one exception, and it is stated at the end of this section.

The submission fee is $49, charged once, and it pays for the editorial review and the periodic re-checks that keep the directory current. It is charged whether or not the listing clears our bar. If we decline a listing, or take one down later, the fee stays with us, because the review work has already been done.

Featured bidding opens at $199 for a 30-day run, and each outbid adds $100. A winning bid is not refunded once its run has started, and it is not pro-rated if the run ends early because the listing came down.

The exception: if you hold the leading bid on a run that has not started yet and someone outbids you, we refund you in full, automatically. You do not have to ask for it.

If you submit a listing

Submit information that is accurate and that you have the right to publish, and keep it current. You are responsible for what your listing says.

We may edit a listing for length and house style, decline it, or remove it at any time and at our sole discretion, with no refund. We are not obliged to explain a decision, though we usually will.

Acceptable use

Do not scrape the site, send automated traffic through our outbound links, attempt to inflate click counts, or interfere with the service or its security. We may block access over any of these, with no refund.

Content and marks

The editorial text, the design, and the arrangement of this directory belong to us. Product names and logos belong to their owners and appear here for identification.

By submitting a listing you grant us a non-exclusive, worldwide, royalty-free license to display and edit it as part of the directory, and to keep an archival copy after the listing comes down.

No warranties

The site is provided as is and as available. We make no warranty that anything here is accurate, current, or complete, and we do not warrant that the site will be uninterrupted or error free.

To the fullest extent the law allows, we disclaim all implied warranties, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limit of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost data, even if we were told that such damages were possible.

Our total liability for all claims relating to the site is capped at the greater of the amount you paid us in the twelve months before the claim arose, or one hundred dollars.

Some jurisdictions do not allow limits like these. Where that is the case, they apply to the fullest extent permitted.

Indemnity

You agree to cover our losses and costs, including reasonable legal fees, arising from any third-party claim that relates to your use of the site, to a listing you submitted, or to your dealings with a vendor you found here.

Governing law

These terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. For any matter not subject to arbitration, the state and federal courts located in Delaware have exclusive jurisdiction, and you consent to their jurisdiction and venue.

Disputes

Any dispute arising out of these terms or your use of the site will be resolved by binding individual arbitration rather than in court. Either side may still bring an eligible claim in small claims court.

You and we each waive the right to a jury trial, and each waive the right to bring or take part in any class, collective, or representative action. An arbitrator may not consolidate more than one person's claims.

Any claim must be brought within one year of the date it arose. After that it is permanently barred.

The rest of the fine print

If any part of these terms is found unenforceable, that part is narrowed to what the law allows and the rest stays in force. Our failure to enforce a provision is not a waiver of it.

These terms are the entire agreement between you and us about the site. You may not assign them. We may assign them to a successor.

Changes

We may update these terms. The effective date at the top changes when we do, and using the site after that date means you accept the updated version. Where a change is material, we will make a reasonable effort to flag it on the site.
